le procureur de la Cour pénale internationale demande un mandat d’arrêt contre Netanyahou
Le procureur de la CPI a indiqué ce 20 mai avoir demandé un mandat d’arrêt contre le Premier ministre israélien, mais aussi contre le ministre de la Défense, pour crimes de guerre et crimes contre l’humanité présumés dans la bande de Gaza. Trois chefs du Hamas sont aussi visés. Israël a fustigé en retour le «déshonneur historique» de la CPI.
«Sur la base des éléments de preuve recueillis et examinés par mon bureau, j’ai des motifs raisonnables de croire que Benjamin Netanyahou, le Premier Ministre d’Israël, et Yoav Gallant, le Ministre de la Défense d’Israël, portent la responsabilité pénale de crimes de guerre et crimes contre humanité commis sur le territoire de l’État de Palestine (dans la bande de Gaza) à partir du 8 octobre 2023 au moins», a fait savoir le procureur de la Cour pénale internationale Karim Khan ce 20 mai. Le procureur Karim Khan vise des crimes tels que «le fait d’affamer délibérément des civils», «l’homicide intentionnel» et «l’extermination et/ou le meurtre». «Nous affirmons que les crimes contre l’humanité visés dans les requêtes s’inscrivaient dans le prolongement d’une attaque généralisée et systématique dirigée contre la population civile palestinienne», a encore affirmé M. Khan.
Les dirigeants du Hamas aussi visés
Les accusations ont aussi été portées contre trois dirigeants du Hamas, notamment Yahya Sinouar, qui dirige le Hamas à Gaza, incluant «l’extermination», «le viol et d’autres formes de violence sexuelle» et «la prise d’otages en tant que crime de guerre». Sont aussi visés Ismaïl Haniyeh, chef du Hamas, et Mohammed Deif, qui dirige les brigades al-Qassam, sa branche armée.
Katz fustige l’amalgame entre le Hamas et le gouvernement israélien
Israël a fustigé en retour le «déshonneur historique» de la CPI. Le chef de la diplomatie israélienne Israël Katz, a très vite dénoncé une «décision scandaleuse»: «alors que les meurtriers et les violeurs du mouvement Hamas ont commis des crimes contre l’humanité contre nos frères et sœurs, le procureur met le Premier ministre, le ministre de la Défense d’Israël sur un pied d’égalité avec les vils monstres du Hamas comme les nazis». Le premier ministre israélien avait déjà déclaré que l’Etat hébreu ne plierait jamais face à la Cour pénale internationale.
Le président Isaac Herzog a quant à lui dénoncé une annonce «scandaleuse», montrant «le danger d’écroulement du système judiciaire international».
Si les juges de la Cour suivent la demande du procureur et viennent à émettre un mandat d’arrêt contre Benjamin Netanyahou, n’importe lequel des 124 États ayant reconnu l’autorité de la Cour serait en théorie tenu de l’arrêter s’il se rend sur leur territoire.
La guerre a été déclenchée par l’attaque du Hamas dans le sud d’Israël, qui a entraîné la mort de plus de 1 170 personnes, selon un bilan de l’AFP établi à partir de données de la sécurité sociale israélienne.
Les représailles de Tsahal ont causé plus de 35 000 morts et une catastrophe humanitaire avec la majorité des quelque 2,4 millions d’habitants menacés de famine et plus de la moitié déplacés, d’après l’ONU.

International Criminal Court prosecutor requests arrest warrant against Netanyahu

If the Court’s judges follow the prosecutor’s request and issue an arrest warrant against Benjamin Netanyahu, any of the 124 states that have recognized the Court’s authority would in theory be required to arrest him if he goes to their territory.
The war was sparked by the Hamas attack in southern Israel, which resulted in the deaths of more than 1,170 people, according to an AFP report based on Israeli social security data.
The IDF’s retaliation has caused more than 35,000 deaths and a humanitarian catastrophe with the majority of the approximately 2.4 million residents at risk of starvation and more than half displaced, according to the UN.
